This is a continuation of our previous blog in our very own Square Foot Exchange’s real estate journal. In this blog, we discuss mainly legal jargon so that you are not clueless when learning about your property rights. In Pakistan. the Revenue Department of the Provincial government is in charge of land matters. The province’s Revenue Department is also in charge of the federal government’s properties. This is the department in which anyone must deal if there is a problem involving or arising from property.
The Divisions form the Districts. There are three to six Districts in each Division. Appointed by the Provincial Government, the Deputy Commissioner or District Coordination Officer leads a District.
Tehsils of Talukas are the subdivisions of districts. There are three to five Tehsils or Talukas in each District. Each Tehsil/ Taluka is led by an Assistant Commissioner, Deputy District Officer (Revenue), or Tehsildar/ Talukadar11.
Who are the people who are important? What are their respective responsibilities?
(Revenue) Assistant Commissioner or Deputy District Officer:
The head of a District’s Sub Division is the Assistant Commissioner or Deputy District Officer (Revenue). The Assistant Commissioner or Deputy District Officer (Revenue) is the Provincial Government’s main representative in the province. He has the authority of an Assistant Collector Grade I or a Collector and hears appeals from Revenue Officers’ orders. Under his command and control, the sub division’s revenue and relief work is completed. They are either members of the Provincial Civil Service or members of the Federal Civil Service who have been transferred to the Provincial Governments.
Deputy Commissioner or District Officer (Revenue):
The Deputy Commissioner (DC) is the chief representative of the Provincial Government and is in charge of revenue and land administration in a district. The head of the land administration in a district with many original, appellate, and revisional powers is known as the DC or DO-R. They are either from the Provincial Civil Service or the Federal Civil Service’s District Management Group, all of which are delegated to Provincial Governments and posted in their districts. Prior to devolution, the title was ‘Assistant Commissioner,’ but under the 2001 Devolution Plan, it was changed to Deputy District Officer (Revenue)
The Commissioner is the head of revenue administration at the divisional level. The British introduced the commissioner scheme, which was kept in place until 2001 when the devolution system was implemented. Some provinces have reintroduced the commissioner scheme, although others are still undergoing changes. Commissioners, also known as EDO-Rs, have supervisory and control authority over subordinate tax authorities and also serve as appellate and revisional courts. The Commissioner is the chief representative of the government in his or her Division and serves as the divisional coordinator of government activities.
Provincial Board of Revenue (BOR):
The BOR is the land administration system’s pinnacle. It is a legal entity. The Board of Revenue (BOR) is made up of several members and is led by the Senior Member Board of Revenue (SMBR). Members of the Board of Revenue also serve as Secretaries of State in their respective departments, such as the Treasury Department.
The Secretary to the Provincial Government for Colony Matters is a Member Colony. BOR is the executive head of a province’s land administration structure. The Provincial Government’s Chief Advisor performs on policies relating to land revenue, consolidation, management, reforms, settlement, and other things. They also serve as a Commissioner for Provincial Relief. In other words, it is through it that the Provincial Governments distribute relief supplies in the event of a disaster such as floods or earthquakes, and it is through it that it declares areas as calamity-affected in order to provide land tax concessions.
